Please read these Terms & Conditions ("Terms") carefully before engaging Apex Aerial LLC ("Apex Aerial," "we," or "us") for any drone photography, videography, or inspection services.
Apex Aerial provides aerial photography, videography, roof inspections, and related services as described on this website. All services are subject to FAA regulations, local airspace restrictions, weather conditions, and property access. We reserve the right to reschedule or cancel a shoot if conditions are unsafe or access is unavailable.
A booking is confirmed upon receipt of a signed agreement and any required deposit. Final payment is due upon delivery of completed media. Returned or unpaid invoices may result in suspension of deliverable access until resolved.
Cancellations made with less than 24 hours' notice may be subject to a cancellation fee. Weather-related rescheduling will be coordinated at no additional charge.
Upon receipt of full payment, the client receives a non-exclusive license to use delivered photos and videos for the purposes stated at booking (e.g., MLS listings, marketing, inspections). Apex Aerial retains the right to use deliverables in its portfolio and marketing materials unless otherwise agreed in writing.
Apex Aerial's liability for any claim arising from services rendered shall not exceed the total amount paid for the applicable service. We are not liable for indirect, incidental, or consequential damages, including delays caused by weather, airspace restrictions, or events beyond our control.
Apex Aerial maintains commercial general liability insurance up to $2,000,000 per occurrence. A Certificate of Insurance (COI) is available upon request.
These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Shelby County, Tennessee.
We may update these Terms from time to time. Continued use of our services after updates constitutes acceptance of the revised Terms.
